Sample Contract
I sell all my puppies on a contract be it a pet or a
show dog, the pet contract is a spay/neuter agreement as well. In both my contracts the buyer agrees to take good care of the puppy and return it to me if they can't keep it.
A copy of the pet contract is below so you can peruse it before signing.
A health guarantee is included in the contracts.

1. Limited Registration
Buyer understands the above
described dog is deemed unsuitable for breeding or show by seller and is
therefore being sold solely as a pet accompanied by an AKC Limited
Registration.
The definition of
"pet" as applied to this contract is defined as any animal which
is deemed unsuitable for breeding/show by its breeder/seller due to its
lack of conformity to the Shetland Sheepdog standard as published by the
American Kennel Club (AKC). This dog is considered a quality
representative of its breed in all other ways.
2.General Care and Well
Being
Adequate fencing adjacent
to and accessible to Buyer’s home will be provided to ensure this dog’s
safety.
Buyer agrees to provide
adequate veterinary care, including but not limited to annual check ups
and heartworm tests, to keep immunizations current according to American
Veterinary Medical Association guidelines, to properly administer
heartworm preventative , to keep this dog free from parasites which might
otherwise threaten the dog’s overall health, to provide adequate housing
for this dog within the Buyer’s home, to confine the dog when outdoors
and refrain from restraining it on a chain or rope and to provide adequate
exercise by walking the dog on a leash.
3. Ownership ( in relation
to terms of this contract)
It is agreed that legal
ownership of this dog will vest with the Seller until and unless all terms
stated are accomplished herein. Violation of the terms of this contract
that could negatively impact this dog’s health, safety or well being may
result in the Buyer being required to return the dog to the Seller within
five(5) days of receipt of notice from Seller. Buyer will be responsible
for the cost of the dog’s transport back to Seller.
4. Spay/Neuter Dates.
Buyer understands the above
described dog is not to be bred at any time and is to be spayed/neutered
between the age of 8 months and 12 months, as specified below. It is
understood that this dog is being sold to Buyer with a Limited
Registration. A dog registered in such a way is American Kennel Club (AKC)
registered, however, any offspring resulting from the breeding of said dog
will not be eligible for AKC registration.
A. Spay/ Neuter Dates.
Buyer agrees to spay/neuter
this dog between the _______day of ______________ and
the ______day of ______________ (when said dog is between the ages of 8
months and 12 months of age). Should Buyer fail to spay/neuter said dog
within the confines of these dates, all rights of ownership will be
forfeited to Seller. Buyer will return this dog to Seller within five(5)
days after the last date of the spay/neuter agreement as stated above.
B. Resulting
offspring/penalties for breeding.
Buyer understands the
penalties as follows for breeding this dog in violation of this contract
and agreement:
a) Ownership of any
resulting litter(s) from this dog is Seller’s’.
b) Ownership of this dog
will be forfeited to the Seller.
c) Buyer will be
responsible to Seller for damage to Seller’s reputation.
d) Buyer will be
responsible for any legal costs incurred by Seller while enforcing this
contract.
5. Guarantee(s)- Seller
guarantees this dog as follows:
1) Health: Dog is
guaranteed free of defects that would make it unfit to serve as a
companion animal. Should this dog be found to be in unacceptable health by
a licensed veterinarian within 72 hours of purchase, Seller agrees to give
Buyer a choice of either a full price refund or a replacement puppy
of similar quality and lineage from the next available litter , in
exchange for the return of the originally purchased dog. If this dog is
not examined by a licensed veterinarian within 72 hours of purchase, the
above guarantee is null and void. Dog is also guaranteed for 1 (one ) year
from the date of purchase to be free of hereditary defects that would make
it unfit to serve as a companion animal. If the dog does suffer from an
hereditary defect within that year that makes it unfit to be a companion
animal, we shall have the right to have the diagnosis confirmed by a vet
of our choosing. If said hereditary defect is confirmed and the dog has it
to such a degree as to make it unsuitable to be a companion animal then
the buyer shall have the choice of either returning the dog for a full
price refund OR keeping the dog and submitting copies of vet fees paid
DIRECTLY related to the hereditary condition and receiving reimbursement
for PAID FEES up to the purchase price of the dog.
2) Temperament: Dog
is guaranteed to be temperamentally sound as of the purchase date of this
contract and agreement. Any temperament flaws brought on by abuse of this
dog is NOT covered under this guarantee. "Abuse " is defined as
any/all of the following:
hitting, excessive raising
of voice, neglect or any other action(s) which is deemed as abuse by
Animal Control, the Humane Society, and/or Sheltie Rescue. Any such
behavior by Buyer will result in Buyer relinquishing all right of
ownership of this dog with AKC papers to Seller.
6. Dispersal/Sale.
Ownership and/or possession
of this dog will not be transferred to a third party without written
consent from Seller. Buyer agrees to return said dog to Seller if it
becomes necessary for any reason for Buyer to relinquish ownership of the
dog purchased. Seller will offer Buyer the going market price, taking into
account the age and condition of dog at time of return of dog.
By signing this contract, I
understand that I am signifying that I have read this contract, have
received a copy of this contract and that I agree with all of its
terms and specifications. I am agreeing not to deviate and/or part from
the specifications stated in the above contract and its addendums. I
understand that this contract is legal and binding.
