Legislation and Your Duty to Manage Asbestos

Regulations (Reg 4) regarding the “The Duty to Manage Asbestos in Non-Domestic Buildings” and the revised consultative document “Control of Asbestos at Work Regulations (CAWR 2006) Approved Code Of Practice (ACOP) L143)”, you will shortly have an explicit duty to have all your non-domestic (commercial) buildings surveyed for asbestos containing materials (ACM’s).
The aim of a survey is to ‘as far as reasonable practicable’ locate and record asbestos type and condition.
The survey report will be used towards providing you with a register for the management of identified ACM’s and also as an informative guide to persons contracted to carry out works in areas where they are likely to disturb or become exposed to ACM’s.
In August 2001 the Health and Safety Executive (HSE) released the guidance document, Method for Determining Hazardous Substances, (MDHS 100) which, is specifically for “Surveying


Sampling and Assessment of Asbestos Containing Materials”.

These guidance notes summarise how to survey a workplace for ACM’s and the requirements for recording the results in a functional format.

It is important to note; for those who commission surveys to be undertaken, MDHS 100 recommends that anyone carrying out surveys or bulk sampling should be able to demonstrate independence (see notes), integrity and impartiality and have appropriate training and experience (see notes).

Notes:

• Independence - A company that is removed or not involved in services such as Asbestos Removal or Re-instatement.

• Appropriate training and experience – As a minimum, the HSE expect surveyors to be accredited with the British Institute of Occupational Hygienists (BIOH) proficiency module P402 – “Building Surveys and Bulk Sampling for Asbestos”.
